PERi-Perks Terms and Conditions

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY ACCESSING OR USING THE PERI-PERKS REWARDS PROGRAM, YOU AGREE THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO BE LEGALLY BOUND BY THESE TERMS AND CONDITIONS, ALL TERMS AND CONDITIONS INCORPORATED HEREIN BY REFERENCE, AND THE DECISIONS OF NANDO’S WHICH WILL BE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PERI-PERKS REWARDS PROGRAM. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, DO NOT ACCESS OR PARTICIPATE IN THE PERI-PERKS REWARDS PROGRAM.
These Terms and Conditions do not alter in any way the terms or conditions of any other agreement you may have with Nando’s for products, services or otherwise. In the event of any inconsistencies, these Terms and Conditions will prevail.
THE PROGRAM
1. The Nando's PERi-Perks Rewards Program (Program) is operated and managed by Nando's Restaurant Group, Inc. (Nando’s) and its affiliates.
2. The Program provides its Members (defined below) with certain benefits (Perks), including the ability to earn PERi-Perks points (Points) for rewards (called Perks) as specified in these Terms and Conditions, and is available in participating Nando’s restaurants in the United States and Canada and on most orders placed via the Nando’s application for compatible smart phones and devices (Nando’s App) or Nando’s website (www.nandosperiperi.com in the United States, and www.nandos.ca in Canada) (Nando’s Website). The Program only applies to purchases made directly through the Nando’s App, Nando’s Website or at participating restaurants. The Program does not apply to purchases made through third-party platforms.
3. By accessing or using the Program, you agree that:
a. All information you provide to Nando’s is accurate, current, and complete, and that you will maintain and update such information as it changes;
b. You will maintain the security of your Account (defined below), take responsibility for all activities that occur using your Account, and accept all risks of unauthorized access resulting from your acts or omissions;
c. You are of legal age under applicable law to form a binding contract, or you are over the age of 13 and will use the Account under the supervision of a parent or legal guardian who agrees to be bound by these Terms and Conditions. The Program, Nando’s Website and Nando’s App are not intended for, nor targeted to, anyone under the age of 13;
d. You are not prohibited by law from accessing or using the Program, Nando’s App or Nando’s Website, including but not limited to the Nando’s App or Nando’s Website;
e. You will not access or use the Program, Nando’s App or Nando’s Website to engage in, commit, or facilitate any illegal, fraudulent or commercial activity;
f. You are either a Canadian resident (but not a Quebec resident) or a US resident;
g. You have read and understood these Terms and Conditions and agree to be bound by them and Nando’s decisions in relation to all matters arising under the Program are final and binding.
h. You are liable for any breaches of these Terms and Conditions by you that occurred as a result of your registration for, access to, participation or other use of the Program or your Account.
CHANGES TO TERMS AND CONDITIONS; CHANGES TO PROGRAM
4. Nando's reserves the right to modify these Terms and Conditions in its sole discretion at any time without prior individual notice, including without limitation, the number of Points awarded for purchases and the number of Points required to redeem Perks. Any modifications will be effective immediately and will be posted here [insert link], and you agree to periodically review these Terms and Conditions in order to be aware of any such modifications. You waive any right you may have to receive specific notice of such modifications. Your continued access to or use of the Program following any such modifications confirms your acceptance of such modifications. If you do not agree to these Terms and Conditions or any modifications made to these Terms and Conditions, you must stop accessing or using the Program.
5. The Program, including any offer or promotion conducted under the Program (e.g. the online reward redemption program), will continue until such time as it is terminated by Nando’s. Should the Program be suspended, terminated or cancelled at any time Nando’s will notify Members via email, in the relevant section of the Nando's Website or via the Nando’s App. Accrued Points will automatically expire upon the termination of the Program.
6. If for any reason the Program is inoperable (including computer viruses, bugs, tampering, unauthorized intervention, fraud and technical failures), Nando's reserves the right in its sole discretion to disqualify any individual who tampers with the Program or systems used to operate and manage the Program, including the Nando’s App and Nando’s Website, and to cancel, terminate, modify or suspend the Program. This includes but is not limited to causes beyond the control of Nando's which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Program
7. Nando’s reserves the right to revoke any stated offer and to correct any error, inaccuracy, or omission (including after an order has been submitted) in the Program.
MEMBERSHIP
8. Individuals can become Program Members (Members) by either:
a. downloading the Nando’s App for compatible smart phones and devices and following the prompts to register and activate the Nando’s App;
b. visiting the Nando’s Website (www.nandosperiperi.com or www.nandos.ca) to register their details and sign up for the Program; or
c. placing an online order via the Nando’s Website or the Nando’s App.
9. Once an individual has registered via the Nando’s App or Nando’s Website, a Program account (Account) will be created and they must verify their Account by clicking on the link sent to them via email and/or text message, as only a verified Member can earn Points and redeem Perks. Unverified Members can still earn Points via the Nando’s App or the Nando’s Website but cannot redeem Points for Perks until verified. Nando’s will issue a unique barcode to each Member upon the creation of their Account.
10. Individuals over 13 but under the legal age of majority in their jurisdiction must have parental/guardian approval to register for the Program and the parent/guardian of the individual must read and consent to these Terms and Conditions. Nando’s may require parents/guardians to enter into a further agreement as evidence of consent to the minor registering for the Program. The Program is not intended for participation of individuals under 13 years old and should not be used by such individuals, even with parental/guardian consent.
11. The Program is intended for personal use only. You may not access or use the Program for any commercial purpose, or on behalf of any club, group or legal entity.
12. There is a strict limit of one (1) registered Account per Member. Each Account requires a unique email address and unique mobile number, both of which must be verified. Members are not permitted to share an Account or barcodes for the Program with any other person.
13. Nando’s does not charge Members any fees to join the Program; however, Members are responsible for any costs charged by their service providers to access and use the Nando’s App or Nando’s Website.
14. If a Member loses or forgets their Account password, they should apply to reset their password using the ‘Forgot Password’ link on the Nando’s App or the Website. A temporary password will then be sent to them via email which will enable the Member to create a new password once the temporary password is entered into the Nando’s App.
15. Members are unable to change their date of birth in the Nando’s App or the Nando’s Website. If these details need to be updated the Member should email CS@nandoscustomercare.com.
16. Incomplete or indecipherable Member registrations or Perks redemption forms may, at Nando’s sole discretion, be deemed ineligible or invalid for the Program.
17. Nando’s reserves the right, at any time, to verify Members (including identity, contact information, age and place of residence), Accounts, Points accruals and Perks redemptions.
18. Nando’s may, in its sole discretion, suspend or terminate any Member or their Account at any time (including restricting access to and use of the Program, and disqualifying Points) if they have breached any of these Terms and Conditions, tampered with the registration, Points accrual/redemption and/or Account verification process, engaged in any unlawful, fraudulent, unauthorized conduct, or engaged in any conduct that may jeopardize fair and proper conduct of the Program.
EARNING POINTS
19. Unless otherwise notified by Nando’s, ten (10) Points will be awarded to a Member's Account for each dollar they spend at participating Nando’s restaurants on eligible items, including full priced items, discounted or special-priced items, and meal bundle purchases. To earn Points, a Member can order eligible items using any of the following four methods:
a. making an online order through the Nando’s App (using the Member’s Account)
b. making an online order through the Nando’s Website (using the Member’s Account)
c. making an in-person order at a participating Nando’s restaurant (scanning the Member’s Account barcode when placing the order)
d. making an in-person order at a participating Nando’s restaurant, and manually scanning in the barcode on the receipt issued by the participating Nando’s restaurant to the Member’s Account via the Nando’s App.
20. Points will not be awarded on: (a) ineligible items, as may be defined from time to time, and which include: alcohol, gift cards; “Dashes” and other charity items; (b) applicable fees and taxes; and (c) any transactions using restaurant support staff discounts, staff discounts and emergency services discounts, regardless of whether the transaction contains eligible items.
21. If a transaction contains both ineligible and eligible items, Points will only be awarded on the eligible items.
22. The spend amount per item will be rounded up to the next whole dollar amount, for example: an eligible item with a value of $12.95 will accrue 130 Points, an eligible item with a value of $21.00 will accrue 210 Points, and an eligible item with a value of $25.05 will accrue 260 Points.
23. Points will expire, and be forfeited, if no transactions are made on an Account for a consecutive period of 180 days. Nando's will then automatically deduct and invalidate any accrued Points and other entitlements from such an Account. For clarity, the Account will not be terminated, and the Member will retain their Account, but their Points will expire and be forfeited. From time to time, Nando’s may amend the point expiration period in its discretion, however if the point expiration period is reduced, Nando’s will notify Members in advance.
24. Members who have earned points prior to Feb 11, 2025, will still have the Points available until they expire at their 180-day (six months) rolling expiry. All points will now be available to redeem for Perks namely, the food menu items listed in their Account at the tiered points level they qualify for (500, 1,000, 1,500, 2,000, 2,500, 5,000).
25. The number of accrued Points required to redeem Perks may change from time to time without prior notice to Members. Additionally, Nando’s may run special promotions at selected Nando's restaurants on selected dates and times which may change the number Points required to redeem Perks.
26. Members can check their Point balance at any time through the Nando’s App or by visiting the Nando’s Website and logging into their Account with their verified email address and password.
27. Each Member is responsible for ensuring that the correct number of Points has been added or deducted to their Account for each eligible transaction. Members must notify Nando's of any apparent discrepancy within fourteen (14) days by contacting CS@nandoscustomercare.com.
28. Nando’s will not be able to add Points related to transactions where the Member does not scan their barcode when ordering at participating Nando’s restaurants, or when the Member orders through the Nando’s Website or Nando’s App without using their Account, however Members can otherwise submit their purchase receipts up to fourteen (14) days after a particular transaction has been made (capped at a maximum of three (3) receipts in any 24-hour period (Daily Cap)) by contacting us at CS@nandoscustomercare.com. After fourteen (14) days have elapsed, the receipt will no longer be considered an eligible receipt to reclaim Points. If a valid and eligible receipt is added by a Member, is under the Daily Cap, is through an approved purchasing platform and is verified by Nando’s, the eligible Points applicable to the transaction will be added to the Member’s Account within 48 hours. If the receipt is deemed invalid or ineligible by Nando’s, it will advise the Member via email. If a Member does not have a receipt or any proof of purchase, Points cannot be allocated to an Account under this clause, nor can refunds be offered.
29. The Nando’s App will only be accepted in participating Nando's restaurants in United States and Canada. From time to time some restaurants may be prevented from processing a Program transaction due to circumstances beyond their control (e.g. internet outage). If a Nando’s restaurant cannot accept the Nando’s App, individuals will be required to visit an alternative restaurant to participate in the Program or obtain a printed receipt for their purchase and add the transaction to their Account using the ‘Add Receipt’ feature on the Nando’s App or the Nando’s Website.
30. If a Member’s phone is lost or stolen, or a verified Member obtains a new phone, they must log onto the Nando’s Website and follow the prompts to update their password. After the password has been updated, the verified Member can download the Nando’s App to their new compatible phone and log in using their verified email address and new password. All information will then sync to the existing verified Member details. While every effort will be made to ensure that the full Points balance for the Account is transferred, Nando's will not be responsible for any Points lost prior to the transfer (including redemptions that may have occurred while the previous phone was lost).
31. Points balances, and Perks offered under the Program, are promotional, have no cash value, and are not transferable, exchangeable or redeemable for cash. Points accrued in multiple Accounts cannot be combined or transferred between Accounts.
REDEEMING POINTS FOR PERKS
32. When redeeming Points for Perks in participating Nando’s restaurants or via the Nando’s App or Nando’s Website, verified Members must have enough Points to redeem against the full value of the Perk using Points alone (i.e., partial payment using a combination of Points and monetary payment is not permitted, nor can you combine Points with a coupon or voucher to make a purchase). Points are redeemed by presenting a Member barcode associated with a verified Account, or the verified Member Account is logged in on the Nando’s App or the Nando’s Website at the time of purchase.
33. Members can login into their Account on the Nando’s Website or the Nando’s App and redeem their Points for Perks listed on the Nando’s Website or the Nando’s App, as the case may be. Once a Member is logged into their Account on the Nando’s Website or the Nando’s App, their Points balance will be displayed so that a Member knows the current number of Points associated with their Account. The catalogue of Perks listed will vary, depending on the number of Points required for redemption of any one Perk, ranging from 500 Points to 5,000 Points. If a Member has enough Points in their Account to redeem a Perk, they will be able to click on the Perk to redeem. Once the redemption form is submitted, the relevant number of Points relating to the redeemed Perk will be deducted from the total Points balance in the Member’s Account within seven (7) days. The following terms specifically apply to the online redemption portion of the Program:
a. to redeem a Perk, a Member must use their registered email address and password to log into their Account on the Nando’s Website and follow the redemption instructions. A Member may only make a Perk redemption by redeeming the required number of Points, which will be specified on the Nando’s Website for each Perk, from their Account. Further conditions that apply to making redemptions may be posted on the Nando’s Website from time to time;
b. from time to time, Nando’s may run sales through the online reward shop in the Nando’s App or Nando’s Website where the Points required for specific Perks are reduced for a limited time. Where Perks are redeemed on sale, no Points will be refunded for Perks redeemed outside the sale period and no Perks can be returned;
c. redeemed Perks will be delivered to the Member in one of the following ways, as determined by Nando’s in its sole discretion, by:
i. post to the delivery address specified by the Member on the redemption form, provided that delivery of Perks will take place in United States and Canada only and the delivery address specified on the redemption form must be a United States or Canadian address;
ii. email (e.g. a voucher or code redeemable through a restaurant, webpage or website) to the Member’s registered Account login email address or to the email address submitted on the redemption form;
iii. electronic download from a webpage or website of a reward supplier (which may deliver the reward directly or may deliver a voucher or code redeemable through a store, webpage or website at the reward suppliers’ discretion); or
iv. such other method outlined on the redemption form, or via the Nando’s Website or the Nando’s App, or another form of notification after submission of the redemption form.
d. Perks will be awarded to the Member only, unless otherwise specified and approved by Nando’s in its sole discretion;
e. subject to subclause (r) below, a reward cannot be exchanged or returned once the redemption form for that applicable reward is submitted online;
f. Nando’s reserves the right to refuse delivery of a reward to a Member if it has reasonable grounds to believe that the Points accumulated by that relevant Member have been fraudulently obtained. Nando’s also reserves the right to verify the validity of proposed Perks redemptions, and to suspend or terminate the Account of any Member who tampers with or subverts the redemption process, or who submits a redemption request inconsistent with these Terms and Conditions;
g. all Perks are available only while supplies last. If a Member redeems a reward that is or becomes unavailable, Nando’s reserves the right to substitute a different item of a similar value and/or type or to credit the Member's Account with the number of Points that were deducted for that redemption;
h. all products advertised as Perks on the Nando’s Website and on Nando’s App, and the number of Points required to redeem a Perk, may be modified or changed at any time by Nando’s at its discretion;
i. any value attributed to any Perks are correct as at the time of publication, but Nando’s accepts no responsibility for any variation in the value of any Perks;
j. an Account may only be used by the Member whose name the Account is registered in. Multiple individuals cannot share one Member's Points or redeem Perks using the Points;
k. all expenses incurred by a Member to redeem a Perk from the Nando’s Website or Nando’s App are exclusively the responsibility of the Member;
l. Perks available for redemption through the Nando’s Website may require the Member to have certain hardware or software to receive or access the Perk. Nando’s is not responsible if the Member does not have the required hardware or software to receive or access a Perk, or cannot access a Perk for any other reason;
m. the Member must comply with all conditions of use for the Perk, as specified therein, and subject to applicable laws;
n. to the maximum extent permitted by law, Nando’s will not be liable to a Member for any Perk which a Member fails to receive due to factors outside of Nando’s reasonable control, including lost or stolen mail or damage sustained during transit and delivery, nor for any unauthorized use of an Account, Points, username or password by third parties. Nando’s is not liable for (i) vouchers or codes that have been lost, stolen, forged, damaged or tampered with in any way, or (ii) if a Perk is delivered to a person other than the person whom the Perk is intended;
o. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL CONDITIONS, WARRANTIES AND REPRESENTATIONS, EXPRESS OR IMPLIED, N RELATION TO PERKS, REWARDS, OR RELATED TO THE PROGRAM, ARE HEREBY EXPRESSLY EXCLUDED AND DISCLAIMED.
34. Redemption of Perks under the Program cannot be combined with any other offers or discounts, unless otherwise expressly indicated by Nando’s.
35. If a receipt issued by a participating Nando’s restaurant contains a barcode, a Member can scan the bar code with the Nando’s App to add Points to their Member Account.
36. From time to time, Nando’s may, at its sole discretion, make additional Perks, promotions and discount offers which may be open to verified Members (or selected verified Members) only. Members may receive personalized offers depending on what Nando's believes a Member might enjoy. For this reason, one Member’s offer may be different to another Member’s offer.
37. Members may receive the following, which are subject to the further individual terms and conditions of each offer listed in the Nando’s Website or Nando’s App or the offer email sent to the Member:
a. one (1) Nando’s voucher for Nata (Birthday Voucher) during the month of their birthday, where the Member has transacted within 6 months prior to the start of their birthday month, verified their Account and entered their date of birth within their Member profile in the Account (Eligible Members). Eligible Members will be sent an email with a barcode for the Birthday Voucher on the 1st day of their birthday month (e.g. if an Eligible Member’s birthday is the 6th or the 29th of September they will be sent the email with the Birthday Voucher on the 1st of September and will have 30 days to redeem the Birthday Voucher). The barcode will be valid for 30 days from the date the email is sent and cannot be redeemed outside of this period, regardless of any circumstances beyond the Eligible Member's control (including public holidays or restaurant closures). A verified Account and photo identification must be presented by the Eligible Member to confirm their identity and birth date registered on their Account. Nando's takes no responsibility for incorrectly entered birth dates. If a Member registers and joins the Program in the month of their birthday, no Birthday Voucher will be provided, the Member must wait until the following year to become an Eligible Member and receive the Birthday Voucher, if they are considered an Eligible Member at that time; and
b. upon verification of their Account as a new Member, Member will receive a free Garlic Bread. 38. From time to time, Nando’s may, in its sole discretion, reward Members with tickets or invitations to Nando’s affiliated or sponsored events, in which case:
a. Members must advise Nando’s in writing (to CS@nandoscustomercare.com) if they are unable to accept the Perk (including physical attendance at an event) no less than 48 hours before the event date and time;
b. Members must, while attending the event, conduct themselves in a respectful and safe manner, ensuring that they do not cause or inflict harm or damage to other event patrons, event staff, Nando’s staff, the event or Nando’s property, and comply with all applicable laws and codes of conduct; and
c. if a Member fails to adhere to this clause, Nando’s may cancel the Member’s Account and expire the Points in Nando’s sole discretion.
LIMITATION OF LIABILITY
39. To the maximum extent allowed by applicable law, Nando’s (including its parents, subsidiaries, affiliates, officers, employees, contractors and agents) is not responsible for, and excludes all liability (including negligence), arising from, any personal injury, loss or damage (including loss of opportunity), or claim, whether direct, indirect, special or consequential, arising in any way out of access to or use of the Program, including but not limited to:
a. any theft, unauthorized access or third-party interference;
b. accrual or redemption of Points;
c. any Perk claim that is late, lost, altered, damaged or misdirected (whether after receipt by Nando’s or not) for any reason beyond the reasonable control of Nando’s;
d. access to or use of the Nando’s App or the Nando’s Website;
e. accepting, using or taking any Perk or other reward or discount offer under the Program;
f. any tax liability incurred by a Member in connection with the Program, including in relation to accepting, using or taking any Perk or other reward or discount offer under the Program;
g. any communication to any Member that is late, lost or misdirected for any reason, including but not limited to spam filters operating on a Member's email account or other system configuration problems; and
h. any errors or any problems, technical difficulties or malfunctions of any telephone network or line, computer system, equipment, server or provider, software, technical problem or traffic congestion on the Internet (whether or not under Nando’s control), including any injury or damage to any individuals computer or technological device related to, or resulting from, participation or registration in the Program, downloading the Nando’s App or any materials in the Program or otherwise accessing or using the Nando’s App or the Nando’s Website.
PRIVACY
40. Information collected from Members at the time of signing up to the Program is subject to Nando’s Privacy Policy available at: https://www.nandosperiperi.com/privacy-policy for US residents and https://www.nandos.ca/privacy-policy for Canadian residents, and this clause. By signing up for, accessing or using the Program, whether via the Nando’s App, Nando’s Website, or otherwise, you agree that Nando’s may collect, use, retain and disclose your personal information to administer the Program, including without limitation to provide and manage products and services you request under the Program, communicate with you about the Program, and otherwise use your personal information with your consent or at your direction, and as otherwise set out in our applicable Privacy Policy and this section. To participate in the Program you must provide your first and last name and a valid email address. We also ask for your day and month of birth so that we may provide members with a birthday reward. We will collect other information from you during your participation in the Program including your purchases and your location to establish the nearest restaurant near you. We collect this to help customize your experience with the Program and the types of offers you received. Nando's may use anonymized data for promotional, marketing, publicity, research and profiling purposes. Members should direct requests to access, update or correct information to our Privacy Officer using the contact information outlined in our Privacy Policy: CS@nandoscustomercare.com for US residents; and CS@nandoscustomercare.com for Canadian residents. Nando’s may share a Members personal information with third party service providers who assist us with the Program, and to Nando’s affiliates some of whom are based overseas (Overseas Recipients). Nando’s cannot guarantee that any such Overseas Recipients will comply fully with the United States and Canadian laws in relation to their personal information but will take reasonable steps to ensure that any such Overseas Recipients are bound by terms and conditions substantially similar to those contained in the applicable Nando’s Privacy Policy. By becoming a Member, you acknowledge and consent to the sharing and disclosure of your personal information to any such Overseas Recipients and agree not to hold Nando’s liable in this regard.
GOVERNING LAW
41. For users in the United States, these Terms and Conditions, the Program, and all related matters shall be governed solely by the laws of Delaware, without regard to the conflicts of law provisions of any jurisdiction. You hereby irrevocably submit to the exclusive jurisdiction of the courts of Delaware in relation to all disputes arising from or related to these Terms and Conditions, the Program, and any related matters.
42. For users in Canada, these Terms and Conditions, the Program, and all related matters shall be governed solely by the laws of the Province of Ontario, Canada and the applicable federal laws of Canada, without regard to the conflicts of law provisions of any jurisdiction. You hereby irrevocably submit to the exclusive jurisdiction of the courts of the Province of Ontario in the City of Toronto in relation to all disputes arising from or related to these Terms and Conditions, the Program, and any related matters.
CLASS ACTION WAIVER
43. YOU ACKNOWLEDGE AND AGREE THAT, TO THE MAXIMUM EXTENT ALLOWED BY LAW THERE SHALL BE NO RIGHT OR AUTHORITY FOR ANY DISPUTE TO BE ADJUDICATED ON A CLASS, JOINT, COLLECTIVE OR CONSOLIDATED BASIS OR IN A PURPORTED REPRESENTATIVE CAPACITY ON BEHALF OF THE GENERAL PUBLIC (SUCH AS CLAIMS AS A PRIVATE ATTORNEY GENERAL OR FOR PUBLIC INJUNCTIVE RELIEF).
DISPUTE RESOLUTION
44. YOU ACKNOWLEDGE AND AGREE THAT, TO THE MAXIMUM EXTENT ALLOWED BY LAW ALL DISPUTES ARE TO BE FIRST ATTEMPTED TO BE RESOLVED IN AN INFORMAL MANNER. IN CASE SUCH INFORMAL PROCESS DOES NOT RESULT IN DISPUTE RESOLUTION, YOU ACKNOWLEDGE AND AGREE THAT, TO THE MAXIMUM EXTENT ALLOWED BY LAW ALL CLAIMS WILL BE BROUGHT AND RESOLVED IN A SMALL CLAIMS COURT.
SEVERABILITY
45. If any provision of these Terms and Conditions is unlawful, void or unenforceable, that provision is deemed severable from these Terms and Conditions and does not affect the validity and enforceability of any remaining provisions.
NO WAIVER
46. Failure by Nando’s to enforce any of its rights at any stage does not constitute a waiver of those rights or of any future rights. Nando’s legal rights to recover damages or other compensation from such an offender are reserved.
